In the overwhelming number of cases, the amount that results from the child support guidelines calculation is the amount of support that will be due. The law presumes that the results of a guidelines calculation are fair and appropriate.

It is possible to overcome the presumption and deviate from the amount of support indicated by the guidelines calculation. This can be done when a parent can show the court that using that amount would be unjust or inappropriate. Usually this will require a very compelling reason, such as catastrophic medical bills or a similar devastating expense. The fact that a monthly child support payment could make it difficult for a parent to afford “unnecessary” expenses will not suffice. This ruling can only be made by a judge.
